Based on the decision of the Board of Selectmen acting as the Board of Health, the installer’s license issued to Dyer LLC has been reissued to William Howard with the following stipulations.
- A sieve analysis of the inplace fill will be obtained by the health inspector and sent to the Umass soil lab at the expense of the installer.
15.255(4) If required by the local Approving Authority, a minimum of one representative sample shall be taken from the in-place fill for a system serving a single family residence and tested for compliance with the grain size distribution specification. One soil test per pit per removal day shall be required for systems with design flows of 2,000 gpd or more.
- If the sieve analysis does not meet the requirements of 15.255 (3) the fill will be removed and replaced with Title 5 sand that meets the requirements , and the installer will lose the ability to install in The Town of Tolland for a period of one year.
15.255(3) Fill material for systems constructed in fill shall consist of select on-site or imported soil material. The fill shall be comprised of clean granular sand, be free from organic matter and deleterious substances, and shall not contain Remediation Waste as that term is defined in 310 CMR 40.0000. Mixtures and layers of different classes of soil shall not be used. The fill shall not contain any material larger than two inches. A sieve analysis, using a #4 sieve, shall be performed on a representative sample of the fill. Up to 45% by weight of the fill sample may be retained on the #4 sieve. Sieve analyses also shall be performed on the fraction of the fill sample passing the #4 sieve, such analyses must demonstrate that the material meets each of the

Based on MGL Chapter 146 Section 53.
It should also be noted that William Howard is the person that this license is issued to. A current copy of his hoisting license should be sent to the Board of Health before Mr. Howard starts a new installation.
The Cemetery Committee has schedule a volunteer cemetery clean up day for Saturday, October 13th.
Robert Bitso asked about the status of turning off the streetlights. WMECO has been notified and will be applying “red caps” the photocell with a red colored cover, visible atop each fixture.
WMECO will suspend billing for the (12) lights once they are red capped. Tolland will still receive a monthly bill for the (2) lights one on Clubhouse Road, pole 3/B1 and one on Colebrook River Road pole 4/5.
Robert’s main concern wasn’t whether the streetlights remain on or off but that the Select Board follows through on what the town’s people voted.
Eric stated that the Board of Selectmen will and are obligated to schedule a Special Town Meeting, if necessary before turning on the streetlights.
Robert requested information on the 2 ATV’s that the Tolland Police Department took possession of. Robert asked if the one ATV was sold to recover the $2,000 in storage charges that was voted at town meeting. It was stated that the 2 ATV’s are not being used and are part of an investigation.
The Board of Selectmen voted on a resolution to join the National Flood Insurance Program.
TOLLAND BOARD OF SELECTMEN
RESOLUTION FOR APPLICATION TO
NATIONAL FLOOD INSURANCE PROGRAM
WHEREAS, certain areas of TOLLAND are subject to periodic flooding, mudslides (i.e., mudflows), or flood-related erosion, causing serious damages to properties within these areas; and
WHEREAS, relief is available in the form of flood insurance as authorized by the National Flood Insurance Act of 1968; and
WHEREAS, it is the intent of this Town to require the recognition and evaluation of flood, mudslide (i.e., mudflow), or flood-related erosion hazards in all official actions relating to land use in areas having these hazards; and
WHEREAS, this Town has the legal authority to adopt land use and control measures to reduce future flood losses pursuant to Massachusetts General Laws Chapter 40A and Chapter 131, Section 40,
NOW, THEREFORE, BE IT RESOLVED that this TOWN hereby:
1. Assures the Federal Insurance Administration that it will enact as necessary, and maintain in force in those areas having flood, mudslide (i.e., mudflow), or flood-related erosion hazards, adequate land use and control measures consistent with the Criteria set forth in Section 60 of the National Flood Insurance Program Regulations; and
2. Vests Theodore Locke with the responsibility, authority, and means to:
(a) Assist the Administrator, at his request, in his delineation of the limits of the area having special flood, mudslide (i.e., mudflow), or flood-related erosion hazards.
(b) Provide such information as the Administrator may request concerning present uses and occupancy of the flood plain, mudslide (i.e., mudflow), or flood-related erosion areas.
(c) Cooperate with Federal, State, and local agencies and private firms which undertake to study, survey, map, and identify flood plain, mudslide (i.e., mudflow), or flood-related erosion areas, and cooperate with neighboring communities with respect to management of adjoining flood plain, mudslide (i.e., mudflow), and/or flood-related erosion areas in order to prevent aggravation of existing hazards.
(d) Submit on the anniversary date of the community's initial eligibility an annual report to the Administrator on the progress made during the past year within the community in the development and implementation of flood plain management measures.
(e) Upon occurrence, notify the Administrator in writing whenever the boundaries of the community have been modified by annexation or the community has otherwise assumed or no longer has authority to adopt and enforce floodplain management regulations for a particular area. In order that all Flood Hazard Boundary Maps and Flood Insurance Rate Maps accurately represent the community's boundaries, include within such notification a copy of a map of the community suitable for reproduction, clearly delineating the new corporate limits or new area for which the community has assumed or relinquished flood plain management regulatory authority.
3. Appoints Eric R. Munson, Jr. Building Inspector to maintain for public inspection and to furnish upon request, for the determination of applicable risk premium rates within all areas having special flood hazards identified on a Flood Hazard Boundary Map or Flood Insurance Rate Map, any certificates of flood-proofing, and information on the elevation (in relation to mean sea level) of the level of the lowest floor (including basement or cellar) of all new or substantially improved structures, and include whether or not such structures contain a basement, and if the structure has been flood proofed, the
elevation (in relation to mean sea level) to which the structure was flood proofed.
4. Agrees to take such other official action as may be reasonably necessary to carry out the objectives of the program.
